In Indiana, it is possible for a married person who does not want to file for divorce to file a Petition for Legal Separation. A Legal Separation, pursuant to Indiana law, can only be in effect for a period of One (1) year. While the Legal Separation is pending, either party, the original person asking for the Legal Separation or the responding party may ask that it be changed into a Dissolution of Marriage action. The purpose of the Legal Separation is to give a person who believes that if he or she lived apart from their spouse they may be able to work on the problems of their marriage and eventually reconcile and get back together. Quite often, once one spouse files a Petition for Legal Separation, the other spouse then asks that it be changed into a Dissolution of Marriage proceeding.
