Mediation has been in effect in Indiana for a number of years. An impartial third person is either selected by the parties or the Court to mediate the outstanding issues between the parties. The Mediator cannot make a decision, but attempts to have both parties reach a consensus upon all contested issues. Sometimes Mediations are conducted with everyone present in the same room and other times Mediations are conducted with the parties in separate rooms. Your lawyer will attend the Mediation to help and advise you as to all legal issues. The Mediator is not permitted to provide legal advice to either party. Mediation, when successful, eliminates long drawn out Court battles and gives the parties a meaningful say in the outcome of their case. At Sachs & Hess, we participate in Mediation as the client’s attorney but can also provide Mediation services.
